![]() ![]() No jurisdictions allow a transfer to be set aside if it occurs after a bankruptcy filing. Most states’ laws provide a statute of limitations of four to six years on fraudulent transfer claims, allowing a trustee to “clawback” up to six years to avoid transfers. Even if they adopt either the UFTA or UVTA model acts, both of which specify a look-back period of four years, states may set the amount of time a creditor has to file a claim of fraudulent transfer against a debtor in court. A transfer is considered fraudulent only if it occurred within two years prior to a bankruptcy filing. The federal bankruptcy code provides a two-year “look-back period” and a two-year statute of limitations on fraudulent transfer actions. Other examples include transferring assets to a relative and setting up shell corporations. For example, a debtor who gives away property in preparation for a bankruptcy filing commits actual fraud. The Bankruptcy Code and most state laws recognize two types of fraudulent transfers: actual fraud and constructive fraud.Īctual fraud occurs when a debtor intentionally donates or gets rid of property as part of an asset-protection scheme. The revision and renaming of the UFTA recognized that the act should apply to some transfers that are inconsistent with standard definitions of fraud and pertain to civil (not criminal) remedies. By 2020, 21 states had enacted versions of the revised act, and two more (New Jersey and Massachusetts) have introduced legislation to do so in 2021. This model act, which had been enacted in 43 states, was revised in 2014 and renamed the Uniform Voidable Transactions Act (UVTA). We tried out the brand's immersion blender and were equally impressed with its power and performance when processing tough ingredients. The Breville's 15-speed dial is at the top of the blender, so you need to use two hands to adjust between slow and fast blending. Its head is also shallower than other models we tested, which minimized suction and prevented food from getting stuck, so it was easier to clean. Its 8-inch stainless steel shaft easily reached the bottom of deep containers and featured a rubbered base to prevent damage to nonstick cookware. The trigger also made it easier to pulse, which was helpful in the emulsion test. Its textured trigger grip and variable speed dial were comfortable to hold and operate, and it didn't feel too heavy, even after a full minute of use. The Breville has several design features that make it intuitive and enjoyable to use. We were particularly impressed with its smoothie performance, where it crushed ice in 40 seconds and chia seeds after just two minutes. The camera uses both a Digic 6 and a Digic 6+ processor, with the former used solely for metering, freeing up the Digic 6+ to handle everything else, including the 61-point AF system with 41 cross-type sensors (five of which are dual cross-type for even greater accuracy). The Mk IV’s native sensitivity runs from ISO 100-32,000, and is expandable to 50-102,400.
